Terms of Service

This document governs the use of Wybalenna’s environmental data management and geological reporting services. By accessing or using our platform, you agree to the terms outlined below.

Scope of Services

Wybalenna provides B2B soil analysis documentation and regulatory filing support for submissions to the Ministry of Environment and Climate Change Canada. Our deliverables include data compilation, geological report drafting, and compliance checklists. We do not provide legal advice or act as a substitute for a qualified environmental lawyer.

Client Responsibilities

You are responsible for providing accurate site data, access to sampling locations, and any prior environmental assessments. You must review all draft reports for factual errors before submission. Wybalenna is not liable for delays caused by incomplete or incorrect information supplied by the client.

Limitation of Liability

Our liability is limited to the total fees paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including regulatory penalties, lost permits, or remediation costs. This limitation applies even if we have been advised of the possibility of such damages.

Intellectual Property

All templates, methodologies, and proprietary software used in preparing your documentation remain the intellectual property of Wybalenna. Upon full payment, you receive a non-exclusive license to use the final reports for their intended regulatory purpose. You may not resell or redistribute our work without written permission.

Termination

Either party may terminate a project with seven days’ written notice. In the event of termination, you are responsible for payment for all work completed up to the notice date. Wybalenna reserves the right to suspend access if payment is overdue by more than 30 days.

Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email to the address on file. Continued use of our services after the effective date of any change constitutes acceptance of the revised terms. The current version is always available on this page.
